These Terms & Conditions (“Terms”) govern your use of the PureAndes website, mobile experience, and related services (collectively, the “Site”) operated by [Legal Entity Name], [Address] (“PureAndes,” “we,” “our,” or “us”). By accessing or using the Site, you agree to these Terms and our Privacy Policy and Return & Refund Policy (collectively, the “Policies”). If you do not agree, do not use the Site.

1) Eligibility & Account

  • You must be at least 18 to make purchases and at least 13 to use the Site with a parent/guardian’s consent.

  • You’re responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.

2) Orders, Acceptance & Availability

  • All orders are offers to purchase. We may accept, reject, or limit quantities at our discretion (e.g., suspected fraud or resale).

  • Products may be available in limited quantities and can be withdrawn, back-ordered, or discontinued at any time. Images are illustrative; actual packaging or appearance may vary by batch or supplier.

3) Pricing, Taxes & Payment

  • Prices are shown in USD and are subject to change without notice.

  • Applicable sales taxes and shipping are calculated at checkout.

  • We accept the payment methods displayed at checkout and may use third-party payment processors. By submitting payment, you authorize us (and our processor) to charge your payment method for the total order amount.

4) Promotions, Discount Codes & Gift Cards

  • One promotion per order unless stated otherwise. Promotions cannot be applied retroactively, have no cash value, and may be time-limited.

  • Gift cards are issued as store credit, are non-refundable, and not redeemable for cash except where required by law.

5) Shipping, Delivery & Risk of Loss

  • We ship to the destinations shown at checkout. Shipping timelines are estimates and not guarantees.

  • Title and risk of loss transfer to you upon our delivery of the order to the carrier.

  • If tracking shows Delivered but you can’t locate the package, see our Return Policy (“Delivered but not received”).

6) Address Accuracy; Undeliverable Packages

  • You’re responsible for providing a complete and accurate shipping address.

  • Packages returned as undeliverable or due to address errors may be reshipped at your expense; original shipping charges are non-refundable.

7) Returns, Refunds & Damages

  • Please review our Return & Refund Policy (incorporated by reference). It explains windows for food vs. non-food items, documentation required (photos, lot/best-by), and how to request a Return Merchandise Authorization (RMA).

  • For taste preferences (not defects), returns are generally not accepted.

  • Optional program(s), such as a first-time satisfaction credit, are governed by the terms stated in the Return Policy.

8) Product Information, Allergens & Safety

  • Ingredients, nutrition, allergens, and usage instructions are provided by manufacturers and may change. Always read labels and follow instructions before use or consumption.

  • Our products are not intended to diagnose, treat, cure, or prevent any disease. Any wellness or cosmetic items should be patch-tested as directed by the manufacturer.

  • If you have severe allergies, consult your healthcare provider. Trace cross-contact may occur at the producer or along the supply chain.

11) Wholesale, Bulk & Resale 

  • Orders suspected of resale or export may be canceled or limited.

  • Wholesale and bulk purchases are subject to separate written terms.

12) User Content; Reviews & Feedback

  • If you submit reviews, photos, recipes, or other content (“User Content”), you grant PureAndes a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display your User Content in any media for marketing and operational purposes.

  • You represent that you own or control the rights in your User Content and that it doesn’t infringe any third-party rights or contain unlawful, misleading, or harmful material. We may moderate or remove User Content at our discretion.

13) Acceptable Use

You agree not to:

  • Violate laws or regulations;

  • Interfere with the Site’s security or integrity, including scraping, crawling, or reverse-engineering;

  • Use the Site to send spam, malware, or harmful code;

  • Misrepresent your identity or affiliation, or attempt to bypass purchase limits.

14) Intellectual Property

  • The Site, including text, graphics, logos, product names, photos, video, and software, is owned by or licensed to PureAndes and protected by IP laws.

  • You may not copy, modify, distribute, or create derivative works from the Site or its content except as expressly allowed.

16) Third-Party Services & Links

  • We may link to third-party sites or use third-party services (e.g., payment processors, shipping carriers). We are not responsible for their content, policies, or practices. Use them at your own risk.

17) Electronic Communications

  • By subscribing to email, you consent to receive marketing and transactional messages. Message & data rates may apply

18) Disclaimer of Warranties

To the fullest extent permitted by law, the Site and all products and services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free.

19) Limitation of Liability

To the fullest extent permitted by law, PureAndes and its affiliates, officers, directors, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, or data, arising from or related to your use of the Site or purchase/use of products. Our total liability for any claim will not exceed the amount you paid for the product(s) giving rise to the claim.

Note for NJ/other states: Some jurisdictions don’t allow certain limitations; parts of this section may not apply to you to the extent prohibited by law.

20) Indemnification

You agree to indemnify, defend, and hold harmless PureAndes and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your breach of these Terms or misuse of the Site.

21) Dispute Resolution; Arbitration & Class Action Waiver

  • Informal process first. Contact us at hello@pureandes.com so we can try to resolve your concern.

  • Binding arbitration. Except for small-claims matters and IP/injunctive relief, any dispute between you and PureAndes will be resolved by binding arbitration on an individual basis under the AAA Consumer Arbitration Rules.

  • Class action waiver. You may only bring claims in your individual capacity, not as a class member or representative.

  • Opt-out. You may opt out of arbitration within 30 days of your first use of the Site by emailing hello@pureandes.com with your name, account email, and a clear statement that you wish to opt out.

  • Venue & law. Unless prohibited, arbitration will take place by documents/teleconference or, if in person, in Hudson County, New Jersey.

22) Governing Law & Venue

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. Where a claim is not subject to arbitration, the state and federal courts located in Hudson County, NJ have exclusive jurisdiction and venue, and you consent to their personal jurisdiction.

23) Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful. Upon termination, provisions that by their nature should survive (e.g., IP, disclaimers, limitations, indemnity, dispute resolution) will survive.

24) Force Majeure

We are not liable for any delay or failure to perform due to events beyond our reasonable control (including natural disasters, labor disputes, acts of war/terror, supply chain disruptions, or failures of third-party services).

25) Changes to the Site or Terms

We may modify the Site or these Terms at any time. Updated Terms will be posted with a new “Effective date.” Continued use of the Site after changes means you accept the updated Terms.

26) Miscellaneous

  • Severability: If any part of these Terms is found invalid or unenforceable, the remainder will stay in effect.

  • No waiver: Our failure to enforce any provision is not a waiver of our right to do so later.

  • Assignment: You may not assign or transfer your rights under these Terms; we may assign ours without restriction.

  • Entire agreement: These Terms, together with the Policies, are the entire agreement between you and us regarding the Site and products.
